"Staff finds that the intensity of the proposed use is very low and will not generate excessive noise or hazard to the surrounding property," the planner said, and recommended continued approval with the conditions that accompanied the prior permit.
Those conditions, as stated by staff, limit the land use permit to the current applicant and make it nontransferable; prohibit clients, customers or outside employees from visiting the property; restrict visibility of the business from the public right-of-way; allow no more than one commercial vehicle dedicated to the business; and set the permit term at 24 months from final approval. The staff presentation also noted the application was advertised in the MDJ and supported by the neighborhood HOA.
A council member moved to approve the permit "as presented for 2800 Dominion Lane," another council member seconded, the floor for public comment on the item was opened and hearing none was closed, and the council recorded a unanimous vote in favor (5–0).
