The Uxbridge Board of Health on Aug. 20 reviewed a recurring compliance problem involving a local recycling operator who has not provided required monthly reports and is reportedly storing material offsite in violation of permit conditions.
Staff said the operator had been asked to submit monthly recycling slips verifying that recycling obligations were met but had not provided them and in an email said he was "storing it in the meantime," which staff noted is not allowed under the permit. "He is in violation of his permit right now," staff told the board.
Board members discussed enforcement options, including issuing a counsel‑backed cease‑and‑desist, revoking the permit and pursuing recoupment of town costs through the courts. Several members cautioned that legal enforcement can be costly and that revocation alone may not prevent the operator from continuing to work; one member noted past legal actions required town council fees but still resulted in some cost recovery.
Staff said the next step is to notify town counsel and request a cease‑and‑desist while the office documents noncompliance. The board asked staff to provide counsel with the permit terms, the operator’s communications and evidence of on‑site storage to support enforcement if needed.
No enforcement vote was taken at the meeting; the board instructed staff to consult town counsel and return with options.
