Committee approves interim study on framework for local government separations

Representative Steve Gist asked the Senate Local Government Committee to back House Joint Resolution 47, a resolution asking the interim Local Government Committee to develop a framework for how local government entities that join together can plan for an orderly, amicable separation.
Gist said the effort grew from local consolidation disputes, citing a prior Belgrade consolidation and a referenced Butte incident. "They must have a prenuptial agreement on how they're going to separate when they comes time to separate," he said, arguing that joined entities — water districts, sewer districts, EMS or other shared services — should have an agreed roadmap for dissolution or separation.
The resolution’s whereas clauses, the sponsor said, recognize that most local governments cooperate effectively but that multiple cases show a lack of cooperation or inefficient outcomes in some consolidated arrangements. Gist told committee members the interim should draft exit clauses and joining protocols so mergers and splits better serve constituents.
No proponents, opponents or informational witnesses appeared at the hearing. After the sponsor closed without substantive committee questions, the panel took executive action later in the session and passed HJ 47 by voice vote; the chair said he will carry the resolution to the floor.
The committee record shows the resolution passed in committee and will proceed to the full Senate for further action.
