"This is putting into law the best interest of the child," the sponsor said, and the bill lists factors including physical and emotional safety, developmental needs, relationships with parents and siblings, and exposure to domestic violence.
Proponents including the Montana CASA GAL Association and the Montana Family Court Awareness Project said codified best-interest elements will reduce inconsistent application across jurisdictions and better ensure children's needs and cultural ties are weighed. "This bill clearly defines the elements ... that we are considering when we are looking at the best interests of a child," Kyla Hailstone said.
Committee members asked whether the Title 41 language would parallel Title 40 and whether differences could create confusion; proponents said Title 41 is a distinct civil context and that courts will rely on the Title 41 definition for dependency-and-neglect matters.
