The House Judiciary Committee adopted an amendment to House Bill 4021 and then voted to report both HB4021 and HB4018 out of committee.
Chair Lightner opened the meeting and read supporting and neutral testimony cards for HB4021, including submissions from the Michigan Poverty Law Program, a Michigan realtor and the State Bar. Representative Wozniak offered an amendment to HB4021 to remove language that would have allowed a magistrate to "conduct a trial" and instead require the magistrate to "provide the rights and information at pretrial," saying the change better preserves due process for tenants and landlords. The clerk recorded the amendment's adoption (11 ayes, 0 nays).
After the amendment was adopted, Representative Bagole moved to report HB4021 with recommendation as amended; the clerk reported the motion carried with 10 yeas, 0 nays and 1 pass and announced the bill was reported with recommendation as amended (as a new substitute). Representative Harris then moved to report HB4018 with recommendation; roll call returned 10 yays, 1 nay, 0 passes and the clerk reported HB4018 as reported with recommendation.
The committee did not take final House-floor action on either measure during the hearing; the actions recorded were committee adoption of an amendment to HB4021 and votes to report both bills for further consideration. The minutes from the prior meeting were approved and Chair Lightner adjourned the committee.
