Boone County approves vacation of Stall/Stahl Road terminus with conditions

Boone County Fiscal Court approved a resolution on Jan. 7 to vacate the northern terminus of Stall (also referred to in materials as Stahl) Road in unincorporated Hebron, removing roughly the final 100–105 feet of county right-of-way and conveying it to the adjoining property owner.
Rob Franksman, the county engineer and assistant county administrator, told the court the viewing committee found "there's no inconvenience to the county or surrounding owners regarding the vacation." The request was made by property owner John Tobin on behalf of Tobin Limited, the developer associated with the Rivers Pointe subdivision.
Approval was conditioned on routine requirements Franksman outlined: the vacation must comply with chapter 178.116 of the Kentucky Revised Statutes; the applicant must survey the vacated area, prepare conveyance plats and deeds, record those documents with the county clerk, and accept that the county retains a general, permanent utility easement over the property. The county also noted that existing private-driveway easements and rights of way that allow access through the Tobin property would remain governed by recorded deeds.
Judge read the resolution and the motion, which was moved by Commissioner Hand and seconded by Commissioner Flagg; the motion passed unanimously with a 4–0 vote. The county indicated conveyance plats and deeds must be reviewed by the Boone County attorney's office, planning staff and public-works staff before the transfer is finalized.
