Gallatin County appoints special deputy prosecutors for two deliberate‑homicide cases

Gallatin County commissioners voted on Aug. 12 to appoint special deputy county attorneys from the Montana Attorney General’s Prosecution Services Bureau to prosecute two deliberate‑homicide cases.
Deputy County Attorney Lee Federilio told commissioners that the county attorney’s office requested appointments to prosecute State v. Foyles (case DC 24 2 11 b) and State v. Darren Abbey (case DC 24 8 4 7 a). Federilio characterized both matters as deliberate‑homicide charges and said the special deputy appointments would come from the Attorney General’s prosecution services bureau and "will not cost the county any money."
There was no public comment on the items. A commissioner moved to adopt resolution numbers 2025‑067 and 2025‑068 as a slate; the Chair seconded, the Chair called the vote and the motion carried, approving both resolutions.
By approving the slate, the commission authorized county staff to accept the Attorney General’s office prosecutors as special deputy county attorneys for the named prosecutions. The move assigns prosecutorial responsibility for those cases to the AG’s prosecution services personnel under the county’s appointment process.
