Board upholds unsecured-load citation; halves $250 fine and conditionally discharges remainder

The Louisville Metro Code Enforcement Board heard a citation for an uncovered or unsecured load under the county ordinance (read into the record as section 51.503B) after the Department of Public Works presented images and a plate run that linked the vehicle to the violation.
The person addressed in the record as “Mister Ward” testified that he had been hauling pallets and cardboard to a fire station and said he did not know covering the load was required. Pete Flood, assistant director of Metro Public Works, said the images showed pallets, wood and plastic strapping and that some of the material was not accepted at recycling centers.
The board found the ordinance violation occurred and upheld the citation. Of the $250 penalty, the board removed $125 and conditionally discharged the remaining $125 on the condition there be no additional incidents in the next 12 months.
The presiding member told the respondent that ignorance of the law is not a defense but noted the board would give the benefit of the doubt this one time and encouraged compliance going forward.
