JBC introduces Proposition 130 implementation bill: law-enforcement distributions and a first-responder death benefit

Pierce Lively of OLLS walked the committee through a draft implementing Proposition 130. He described two primary components: (1) a distribution formula that directs funds to law enforcement agencies using a floor-plus-multiplier approach and (2) a first-responder death benefit that would pay a $1,000,000 lump-sum to the surviving family member of an eligible first responder.
Mr. Lively explained a funding mechanism that would send a $500,000,000 warrant to PERA for investment; the earnings on that principal would be used to seed a Peace Officer Training and Support Fund. Beginning July 1, 2027, the fund distribution would be tied to PERA earnings on that $500 million, capped at $35,000,000 annually, with a guaranteed floor of $15,000,000 (the state would top up to the floor if earnings fell short). The bill also establishes a death benefit fund initially topped to $10,000,000 and funded from the general fund to support $1,000,000 payments.
Committee members raised multiple concerns: whether distributions would supplant existing local funding, the potential general fund impact of the top-off and floor guarantees, how the reserve interacts with the $500,000,000 warrant, definitions of eligible emergency medical service providers, and the breadth of an "occupational disease" standard. Mr. Lively said the draft includes an annual audit requirement for local governments that receive funds and that local audits would be reviewed by DPS for compliance.
Madam Vice Chair moved to introduce the Proposition 130 implementation bill; there were no objections and the committee moved the bill 6-0 to introduction. Members asked staff to continue negotiations on technical definitions and said they expected to continue work on remaining items in follow-up meetings.
