Boulder County commissioners deny Rodriguez TDR PUD sketch plan, 2-1

Boulder County commissioners voted 2-1 on July 10, 2025 to deny docket SD2300003, a transfer-development-rights (TDR) planned unit development sketch plan for four proposed lots at 6184 Niwa Road.
Pete Lowrance, a Community Planning and Permitting staff member, told the Board that the original public hearing was held May 6, 2025 and that both staff and the Planning Commission recommended denial of the sketch plan. "The public hearing was closed. Positions were split between the 2 commissioners in attendance, so the docket was held over to today," Lowrance said.
The applicants, represented by Sean Stewart, reiterated that they "stand by the arguments that day" and argued the TDR program was intended to move development "from more rural areas to more densely, densely subdivided areas." Stewart said he did not expect the Board to reopen public testimony absent new information.
During deliberation, one commissioner said the sketch plan "doesn't conform with the Boulder County comprehensive plan generally" and noted they largely agreed with staff findings. The same commissioner said they disagreed with staff on one specific criterion: "there's an increase in fire hazards by this subdivision by increasing the density in this area," and moved to deny docket SD2300003.
A second commissioner seconded the motion. The Board voted by voice; the motion to deny carried on a 2-1 vote. One commissioner stated opposition during the roll call.
Chair Loeterman confirmed there would be no additional public testimony at this meeting because the hearing record had been closed previously, and the Board moved into deliberation with a third commissioner who had reviewed the May 6 hearing video. After the vote the Board had no further business and adjourned.
The denial is a final action on the sketch-plan request at this meeting; the record shows staff and the Planning Commission recommended denial and that the Board based its action on conformance with the county comprehensive plan and on a finding of increased fire risk. No additional public testimony was taken at the July 10 meeting, and the docket will be reflected in the county record as denied.
