Grand County’s Board of County Commissioners approved a multi-part acquisition of 58.5 shares of the Vail Ditch, authorizing assignment documents, two wire transfers and a transfer fee as part of the county’s strategy to consolidate water rights and associated leases.
Manager Ed Moyer explained the package is the completion of a water-rights purchase previously approved through the county’s purchase-and-sale authority, noting: “Total cost, through ORT that you've already approved is 409,500.” Commissioners authorized the chair to sign notices of assignment (four deeds comprising 56 of the 58.5 shares), approved a wire transfer of $392,000 to 1031 Exchange Experts LLC for 56 shares, and a separate wire of $17,500 to Grand County Sweetwater LLC for the remaining 2.5 shares.
The board also approved paying a $100 transfer fee per share to Grand County Irrigated Land Company (total $5,850) and authorized the county manager to execute the assignment of lease after closing so the county can assume the lease and sublease arrangements with Grand County Mutual Ditch and Reservoir Company.
Why it matters: Water rights and ditch-share ownership in Grand County affect agricultural irrigation, municipal and county water planning, and long‑term resource management. The county’s purchase consolidates shares and assigns leases to the county and its irrigation entity.
Questions and next steps: Commissioners asked for clarity on the share accounting (56 vs. 58.5 shares) and the acreage/mileage used to calculate service areas; manager Moyer said staff will provide follow‑up on mileage, and that the cost caps are the operative limit under the agreements. The transactions were approved and are contingent on standard closing and legal review.
