The Utah County Board of Commissioners voted to adopt an ordinance amending the county zone map from CE‑1 to RA‑5 and to approve the associated development agreement, but exempted two parcels after one property owner declined to sign.
County Attorney’s Office staff said the development agreement package ties multiple lots via a declaration of zoning lot, and noted two parcels identified by tax serial numbers — 300720028 (Hughes/Morley parcel, about 57 acres) and 300720033 (Kent Carroll parcel, just under 7 acres) — are tied together but that the Carroll property’s owner has reaffirmed unwillingness to sign the agreement. The county attorney advised commissioners of multiple options, including denying both items, approving both, exempting the two parcels, continuing the matter, or redrafting the agreement to incorporate owner requests.
Commissioners expressed appreciation for the time invested by property owners and staff and concluded exemption of the two noted parcels was the most practical path forward given the current impasse. One commissioner said, “I was hoping that we could have a real clean one on this thing. It looks like it’s gonna be a little muddled,” conveying concern about the unresolved signatures.
The commission voted to adopt agenda items 3 and 4 together and to exempt parcels 300720028 and 300720033 from the rezoning and development agreement; the motion passed on a recorded voice vote (2‑0). County staff said further work may be needed if parties seek a different arrangement later.
