Utah County sets public hearing on Vivian Park road vacation

The Utah County Commission voted to set a public hearing for April 15 to consider a petition from the Vivian Park Homeowners Association to vacate two rights-of-way — Fairfax Drive and Vivian Way — and transfer control to the HOA.
Reid Dixon, representing the Vivian Park HOA, told commissioners the subdivision dates to the 1910s, the asphalt was last overlaid in 1999, and residents already treat the two streets as private. He said the HOA held an informal vote that was unanimously supportive and a later formal vote strongly in favor, though a small minority opposed. “If this were vacated and made private, all of the current members of the HOA and property owners would continue to have access the same way they do now,” Dixon said.
County public-works staff noted maintenance concerns in narrow sections and said the county could inspect and evaluate whether full-depth repairs or a mill-and-overlay are required. Staff also flagged that the road has been used as an access point for a trail system (the South Fork Trail), and vacating it could require alternate access planning.
Commissioner Lee and other commissioners said a public hearing would allow neighbors and other stakeholders to raise concerns — including emergency access and trail connectivity — before any final decision. A motion to set the hearing for April 15 at 3 p.m. passed by voice vote, recorded as 3-0.
The public hearing will allow county staff to present engineering options and for residents to comment on maintenance expectations, potential gating, and emergency access.
