County staff presented an amended vehicle‑emissions inspection ordinance to implement House Bill 101, which requires certain counties to establish a three‑year pilot emissions‑inspection program for specified diesel vehicles. Staff said the ordinance was updated to align with statutory language and to add technical and administrative details (inspection categories, computerized vs. visual inspections, appendices for procedures and public‑fleet rules).
Commissioners raised concerns about a discrepancy in the statute’s model‑year cutoff (a drafting error that referenced 1997), and staff said the DMV recommended a one‑year waiver approach for certain model years to address a legislative typo. After legal and operational discussion, the commission amended the local ordinance to change references of the older model‑year cutoff to Feb. 2006 (02/2006) where the statute had inconsistent years and adopted the ordinance. The amendment effectively narrowed the vehicles subject to visual inspection and incorporated a waiver mechanism to mitigate legislative drafting errors.
Staff noted implementation tasks remain: finalizing appendices A–G, communicating requirements to local mechanics/inspection stations and confirming technician training timelines. The commission asked staff to continue outreach to state legislators to correct the statutory drafting if possible, but implemented the ordinance with the adopted date adjustments to meet the statutory deadline.
