The Utah County Commission voted unanimously to approve an agreement with Gallagher to serve as the county's employee benefits broker, approving the contract with a stipulation that Gallagher pay half of the COBRA administrative fees, not to exceed $4,200.
Commission discussion focused on an item omitted from the county's request for proposals (RFP): COBRA administrative costs estimated in the meeting at about $8,400. Cammie, a county staff member, said Gallagher had offered to "split that in half with the county on just a good faith basis." The commission added contract language to reflect the shared payment and set a not-to-exceed limit of $4,200 for the county's portion.
Commissioner (S2) framed the debate around fairness to other bidders and the county's responsibility for the omission. "It is not Gallagher's problem that the county made a mistake," Commissioner (S2) said, urging accountability but acknowledging Gallagher's willingness to partner with the county. Robert Moore of the County Attorney's Office clarified contract mechanics and confirmed that the current provider, NFP, would receive any commissions tied to existing arrangements through the end of the year; Gallagher's compensation structure would take effect in January under the newly approved contract.
The commission recorded a voice vote of 3–0 to approve the Gallagher agreement with the COBRA-stipulation change. Commissioners also approved a related letter of authorization and a separate agreement (Culver Administrative and Compliance Solutions) with the same COBRA split stipulation and a not-to-exceed $4,200 limit.
The commission instructed staff to revise the contract language on the record and proceed with the chair's authorization to sign the amended agreement. The items passed by roll/voice vote were recorded as unanimous (3–0).
