County approves Beckstead agricultural protection area after editing findings to remove wording implying consent to road sale

Utah County commissioners approved creation of the Beckstead Agricultural Protection Area on a 3–0 vote after clarifying language in the findings of fact and decision that had suggested the applicant had ‘consented’ to future road actions.
Commissioners focused on finding number 14 and the decision language where the draft said the applicant had ‘consented’ or that the commission’s findings would operate as a restriction on the property owner. One commissioner proposed striking the wording ‘‘consented’’ and replacing it with ‘‘stated’’ and removing language such as ‘‘as a hindrance.’' County staff and the county attorney said the record should reflect what the applicant actually said at the public hearing and that the changes would better capture the intent.
"I will move that we approve and authorize the commission chair to sign the Beckstead Agricultural Protection Area with the change as stated by commissioner Ivy for number 14 in the findings of fact," said an elected official making the motion. The motion was seconded and passed unanimously.
County counsel and staff explained the practical effect of the edits. Robert Moore of the county attorney's office noted the record could reflect the applicant's on-the-record statements without creating a new legal encumbrance: "That would be just a reminder to him... it doesn't do anything else than that," he said, characterizing the language as an acknowledgement of what was said at the hearing rather than an acquisition of property rights.
The changes included putting a period after the clause approving the agricultural protection area "without modification," striking subsequent language that referenced consented road actions, and replacing harsher wording with phrasing that the applicant had "committed to working with the county in regards to the proposed expansion of the right of ways" for the identified road segments. Commissioners said the edits were intended to reflect the record accurately and to avoid implying an automatic future conveyance or sale.
Following the vote, the chair was authorized to sign the modified documents. The action resolves this agenda item administratively; no additional formal action was recorded during the meeting.
