At its Aug. 15 meeting the Evansville Board of Zoning Appeals approved multiple variances and administrative findings. Key outcomes and brief descriptions follow:
VAR-2024-058 (3010 N. Bedford Ave.) — Petitioner: Andy Laidoff (represented by Irwin Laidoff). Request: rear-yard setback relaxation to 0 feet and to allow accessory structures larger than the residence to legalize an existing addition. Outcome: Approved 6–0. Staff said the applicant had notified neighbors; no remonstrators appeared.
VAR-2024-059 (13713 Darmstadt Road) — Petitioner: Kyle Biggs. Request: allow a detached 30-by-50 garage that would exceed the residence’s square footage. Outcome: Approved 5–0 (one member absent). Biggs told the board the structure is for personal use and neighbors contacted were supportive.
VAR-2024-060 (8146 Peach Blossom Lane) — Petitioner: Reese Hamilton. Request: relax maximum driveway width from 24 to 28 feet and legalize unpermitted fence heights and driveway expansion. Outcome: Approved 5–1. The petitioner said the driveway expansion would allow household drivers to park off the street; one member voted no.
VAR-2024-061 (1701 N. Heidelbach Ave.) — Petitioner: Gemtown Holdings LLC (represented by Jeff Justice). Request: reduce front and side green‑space requirements to zero and permit gravel parking for a commercial storage warehouse conversion. Outcome: Approved 6–0. Justice said interior electrical and sprinkler improvements require site relief to proceed.
VAR-2023-096 (35 W. Franklin) — Administrative findings related to a December variance for an electronic message sign at a car wash were presented for the record after an appeal was filed; the board approved the written findings 4–2 (two members dissented), consistent with prior vote division on the underlying variance.
Procedural notes: The board recorded roll-call tallies on each motion, required the Brinker's approvals to be recorded as use‑and‑development commitments in the land records, and asked staff to follow up with INDOT on guidance about mixing on‑ and off‑premise electronic messages on state control routes. The board’s next meeting is scheduled for Sept. 19, 2024.
Vote tallies (selected): VAR-2024-058: 6–0; VAR-2024-059: 5–0; VAR-2024-060: 5–1; VAR-2024-061: 6–0; VAR-2023-096 findings: 4–2.
