Ravalli County revokes agricultural covenant to allow vault toilet at state recreation site

Ravalli County commissioners on July 10 approved revocation of an agricultural covenant on a parcel owned by Montana Fish, Wildlife & Parks so the agency can proceed with sanitation permitting to install a vault toilet at an established recreation parking area.
Planning presenter Rob reviewed the statutory basis and told the board that Montana Code Annotated allows a governing body to revoke an agricultural covenant if the land will be used by a government entity for public purposes. He said the parcel is state-owned, functions as a developed parking and recreation area, and that revocation would enable the state to install a vault toilet similar to other fishing access sites.
Rob stated, “In my opinion, this is an appropriate use of that kind of exemption,” and recommended the BCC revoke the agricultural covenant recorded under document number 748,387 for parcel number 1079510 (CS74835-A) as requested by Montana Fish, Wildlife & Parks. Commissioners discussed conditioning the revocation on the parcel’s continued public ownership to prevent a future conversion to private, buildable lots, and agreed to capture such protections in the record.
A motion to revoke the covenant (document 748,387) passed on recorded aye votes. Planning staff said they will attach the minutes to the revocation documents and submit them to Fish, Wildlife & Parks for recording.
