VMRC tables shellfish-tagging rule to SMAC review, sets earliest implementation in 2026

Staff explained the amendments align Virginia with the National Shellfish Sanitation Program (NSSP) and would require harvesters to record more precise growing-area information and, where available, lease numbers on tags for traceability in disease/outbreak investigations. Staff and the Virginia Department of Health said increased traceability would protect public health and limit large-scale closures by enabling precise traceback.
Industry speakers and some commissioners raised implementation concerns: large inventories of containers and printed packaging currently carry the word "shellfish," not the proposed "shell stock" or lease identifiers; immediate implementation could impose substantial costs. Commissioners expressed interest in additional SMAC review and in phasing and targeted education. The commission’s motion directed staff to bring the proposal to SMAC, ask SMAC to develop an implementation timeframe (the motion specified an earliest effective date in 2026), and report back.
Chair recorded the motion to table and send the regulatory language to SMAC; the motion passed unanimously.
