Trustees accept Planning & Zoning recommendation for Boer Avenue annexation; ordinances set for first reading

Director Apt told trustees the petitioner seeks annexation and rezoning to M-1 and requires special uses for motor-vehicle repair, vehicle sales and outdoor storage because existing site conditions do not meet the village's Unified Development Ordinance. The planning commission held a public hearing on Nov. 7 and recommended approval with conditions, including a 15-foot maximum for outdoor storage within 20 feet of a lot line.
During trustee questions, several members raised enforcement concerns after comparing conditions on nearby properties. Trustee Baumann noted prior compliance issues at a separate site and asked what enforcement "teeth" the village has; staff said violations could be pursued through code enforcement and, for special-use conditions, could lead to adjudication or rescission of the special use if terms are violated.
Pat Griffin, attorney for the applicant, said the site will store trailers rather than bulk materials and that a 15-foot maximum accommodates typical trailer heights: "Most trailers are 13 6, which is why we arrived at that 15 foot maximum," Griffin said.
Trustee Marisak moved to accept the planning commission's recommendation; Trustee Baumann seconded and the roll-call vote was unanimous in favor. Clerk noted three related ordinances on the agenda (annexation, rezoning, and special uses/variances) are first readings and will not be voted on tonight; trustees asked that those ordinances be scheduled for separate action at the next meeting rather than placed on consent.
The board's acceptance of the planning commission recommendation does not, by itself, adopt the ordinances; the three ordinances will return for formal consideration at the first reading and subsequent readings as required.
