Community Development Director Joshua Chandler presented the staff report, describing the strip as a narrow (approximately 4.9‑foot) portion of right‑of‑way with topographic constraints, no public improvements or utilities, and limited potential for future public use. Chandler said the applicant, property owner Lonnie Capps, supplied the required survey, legal description and signatures representing at least two‑thirds (≈3.15 of 4.7 acres of affected area) as required under local code. Public postings and notices were made in accordance with requirements and staff reported no public objections as of the date of the staff report.
The applicant was present but did not add testimony. No members of the public came forward either for or against the vacation during the hearing. Councilor Dan Richardson moved to adopt the special ordinance (amending the motion to add the word 'vacation' in the title to reflect the ordinance language); the motion was seconded and carried by voice vote. The council then recessed into an executive session on labor negotiations; Councilor Randall declared a conflict and recused himself from labor negotiation matters.
The ordinance adopts the findings in the staff report, requires the applicant to pay recording and mapping fees, and reflects staff's determination that the public interest is not prejudiced by the vacation given the parcel's configuration and lack of public infrastructure.
