Council approves waiver of plat to split Hancock Road parcel into two lots

The Town Council voted unanimously to approve waiver of plat application WP34-24 to subdivide a 14.13-net-acre property on the east side of Hancock Road into two net-acre lots (3.21 acres for the front lot and 10.92 acres for the rear lot).
Staff described the application as the first waiver of plat to reach council under amended eligibility rules requiring homestead status of 20 years or a parcel with at least three times the minimum acreage and a deed restriction against further subdivision. The staff report described required recordation items: a declaration of restrictive covenants prohibiting further subdivision without town consent, a driveway easement and maintenance agreement, recordation of a quitclaim deed dedicating 40 feet for Hancock Road, a right-of-way encroachment agreement, and removal of a dumpster enclosure shown on the proposed lot survey.
A neighbor asked whether an existing wall located in the ingress/egress easement would have to be moved if it needed replacement; staff and the applicant confirmed any replacement must be outside the dedicated right-of-way. The applicant’s representative, Courtney Krush, said the property owner agreed to the restrictive covenants and to the associated recordation requirements.
The council moved to approve with the stated covenants and conditions; the council’s roll-call vote was unanimous.
Next steps: staff will record the covenants and related documents required for the waiver and confirm the removal of the dumpster enclosure as a condition of recordation.
