The Kearney Planning and Zoning Commission voted to approve the Westwood North preliminary plat, adopting staff recommendations with three key amendments: the 25-foot landscape buffer proposed along Nation Road will be reduced to a 15-foot open-space tract maintained by the homeowners association, the required street connection between Stella Circle and Nova Circle was eliminated, and lots on Nova Circle must be at least 100 feet wide if the connection is not made.
The action resolved several outstanding design-standard issues staff had flagged, including buffers for lots that back up to public streets, 10-foot pedestrian ways required for blocks longer than 900 feet, and multiple cul-de-sacs that exceed the 500-foot guideline. Staff had recommended either dedicating a wider open-space buffer to the city or finding alternatives to meet code; the commission approved a compromise that places the 15-foot tract under HOA ownership rather than dedicating it to the city.
Staff outlined the remaining technical conditions and recommended approval contingent on submission of a revised preliminary plat that incorporates all conditions. According to staff, the applicant updated the lot data table, added an extra lot in Phase 3 and provided a revised right-of-way alignment for Nation Road; staff advised that Eldridge Drive meet residential collector standards and that pedestrian ways and revised page content be provided in the final submittal. The commission and applicant agreed the developer must submit the revised preliminary plat to staff for review and signature.
Engineer Ron Cowher of AGC Engineers said the applicant had worked with staff to reduce outstanding items and apologized for his demeanor at the prior meeting, telling commissioners, "I wanna start off by setting the record straight of last meeting… I wanted to apologize if you felt like I talked down to you." Cowher and developer Tim Harris (Star Development) argued that some code requirements — notably pedestrian cut-throughs between lots and strict cul-de-sac length limits — posed marketability and topographic challenges. Cowher noted an on-the-ground grade and drainage configuration that, he said, made certain street connections difficult and showed distance analyses suggesting some cut-throughs change walking distance by only a few dozen yards.
Harris said the developer was willing to accept the 15-foot tract under HOA maintenance and asked for clear covenants to ensure ongoing upkeep; he told the commission he and the builder were "in agreement with most everything" but worried that narrow cut-throughs between back yards would harm lot sales and create long-term maintenance and security problems. Commissioners questioned whether dedicating additional acreage to the city would be appropriate and raised concerns about long-term city maintenance, while acknowledging HOAs can struggle financially over time.
On cul-de-sac design, Cowher cited the Kearney Fire Protection District's approach, which evaluates the number of homes served rather than strict cul-de-sac length, and noted Nova Circle would have 24 lots — below the district's 30-house threshold mentioned during the discussion. Commissioners discussed alternatives, including making the Nova Circle section a private street or reducing the lot count by widening lots; the approved amendment requires a minimum 100-foot lot width on Nova Circle in lieu of the Stella–Nova connection.
Commissioner speaker 8 moved to approve the plat with the amended conditions, a motion seconded by speaker 2; the commission voted in favor by voice vote and the chair declared the motion carried. Following the vote, staff confirmed the applicant must submit a revised preliminary plat that incorporates the amendments and the remaining staff conditions.
The commission also reviewed the monthly permit report (no additional action) and adjourned the meeting. The developer and staff will coordinate the revised plat submittal and any final technical checks before signatures are issued.
