Evansville APC recommends three rezonings to City Council; one petition withdrawn

The Area Plan Commission of Evansville and Vandenberg County recommended approval of three rezoning petitions on July 11 and recorded one withdrawn petition.
Staff presented REZ-2024-016, a request to rezone a portion of 12 East Columbia Street from R2 to C4 with a use-and-development commitment to formalize an existing American Sanitary Supply commercial warehouse and to exclude uses the Evansville Promise neighborhood resolution had identified as disfavored. Planning staff said the request is consistent with the city's 2035 future land use plan and with prior zoning on nearby parcels. Petitioner representatives Joshua Stevens (Acura Engineering) and Katie Smith (American Sanitary Supply) told the commission they were correcting noncompliance items on the property, including removing an unauthorized gravel drive; Stevens said, "we were just notified that property wasn't in compliance ... and we had this and it was a gravel drive ... so we're taking care of that as well." The commission voted 11-0 to recommend the rezoning to City Council, which will consider the petition at its July 22 meeting at 5:30 p.m.
Two additional rezoning petitions were advanced with little debate. REZ-2024-021 (1921 East Michigan Street) was described by staff as a straightforward downzoning from C1 to R1 for an existing house; Jessica Ruiz of 1937 Joyce Avenue spoke for the record. The commission voted 11-0 to recommend approval to City Council. REZ-2024-022 (East Olmstead Avenue) — a similar downzoning from M2 to R1 for a parcel with an existing house and a buyer in place — was introduced by staff and presented by applicant Matt Layman (Layman and Son Consulting). The commission approved that recommendation with a 10-0-1 roll call (10 yes, 1 abstention), forwarding it to City Council.
Staff also announced that docket REZ-2024-023 (Baker Avenue / Michael S Martin Realty) had been withdrawn prior to consideration. The commission reminded the public of procedural rules for rezonings: petitioners and remonstrators are sworn, must state name and address for the record, petitioners get 10 minutes to present and remonstrators 10 minutes with a 5-minute rebuttal allowed for petitioners.
All three recommended rezonings will be scheduled for City Council consideration; the commission recorded the public record and the votes to forward its recommendations.
