The Milledgeville City Council on Aug. 27 opened a public hearing on a proposed special use to allow a Circle K convenience store and gas station at 2345 North Columbia Street.
The applicant asked the council to permit withdrawal of the application without prejudice so the applicant could address concerns raised at the Planning and Zoning hearing and, if desired, refile. City legal counsel explained that 'without prejudice' allows the applicant to refile at any time, whereas withdrawal 'with prejudice' would require waiting six months before reapplying.
After attorney comment and brief discussion about the timing of the original filing (the application had been filed in February and heard in March), the council moved and voted to allow withdrawal without prejudice; the clerk recorded unanimous ayes. The withdrawal does not prevent the applicant from refiling a modified application.
