The Port Commission approved a tenant relocation plan prepared under California relocation law to address the anticipated displacement of approximately 76 tenants caused by the Pier 27 cruise terminal and America's Cup venue construction.
Roy, assistant deputy director of real estate, told commissioners the plan describes the projects' footprints, identifies affected tenants and outlines the relocation-assistance program. Eligible tenants may elect either reimbursement for actual, reasonable moving costs or a fixed payment up to $20,000 calculated under a statutory formula tied to average net business earnings. Tenants must file claims within 18 months of their move; an appeals process to the city's relocation appeals board is provided.
Staff estimated total relocation costs for the two projects at approximately $1,800,000 including a 20% contingency and said relocation impacts were analyzed in the EIR. Port staff said they have identified relocation options for many tenants and expect to place roughly 75—5% of affected tenants, while acknowledging some uses tied to the Northern Waterfront (for example, storage supporting Fisherman's Wharf) may be difficult to reproduce nearby.
Commissioners questioned the eligibility definition and the process for reviewing claims of 'reasonable' costs; staff said claims require documentation and that unresolved disputes may go to the relocation appeals board. The Commission approved Resolutions 11-81 and 11-82 adopting the relocation plan.
