Port approves sole-source lease for Bay Natives nursery at Jennings and Cargo Way

The Port Commission approved a sole-source retail lease with Bay Natives for a native-plant nursery to operate at Jennings Street and the terminus of Cargo Way.
Jeffrey Bauer, the port's leasing manager, told commissioners the site comprises approximately 6,273 square feet of paved land and staff recommended a 13-month initial lease with a 48-month extension option. Under the port's retail leasing policy, leases are normally put out to bid, but Bauer said staff may negotiate direct leases when public offering is impractical for small operators. He said the site has been vacant since February 2006 and the proposed use advances the Southern Waterfront Community Benefit and Beautification Policy.
Bauer described the proposed financial terms as stated in the staff report: rent during the first year of $13.80 (as reported by staff) with a percentage-rent provision thereafter; staff said the arrangement allows the port and the tenant to evaluate sales and operations before any longer-term commitment. Bauer also told the commission that the staff report found the lease exempt from the California Environmental Quality Act.
A motion to approve the lease was made and seconded and the commission adopted Resolution 11-61 by voice vote. No public testimony opposed the proposal during the item.
