Montgomery board approves Horton PUD preliminary plat and final plat, sets public-improvement deadline

The Village Board of Montgomery approved Ordinance 20 87 (a planned-unit-development preliminary plat) and the accompanying final plat for the Horton subdivision after staff reported clarifications and an updated timeline for public improvements.

Director Aft told trustees the petitioner and staff had resolved utility concerns and that the completion date for Unit 1 public improvements has been revised to Aug. 31, 2025 to accommodate a potential closing delay. The board discussed Unit 2 plans (73 single-family homes) and whether interim maintenance, including snow removal, would be enforced if Hartz or another builder retains control during the winter.

Trustees asked whether the village should call the developer’s bond if work was not completed, with one trustee saying calling the bond could hinder sale and closing and that Horton, as a large national homebuilder, would be motivated to meet standards. Director Aft said village expectations would be noted to Hartz and staff will work to ensure snow removal and compliance if Hartz remains responsible.

Motions to approve the items were moved and seconded on the record and passed on roll call. The ordinances and plat include the updated public-improvement completion date in the conditions attached to the approvals.
