Forest Hills board tables updated Title IX policies after heated debate

The Forest Hills Public Schools Board of Education on Aug. 19 voted to table proposed updates to Title IX–related district policies after a prolonged discussion about legal risk, definitions and student privacy.
Board member Holly moved to postpone consideration of the Title IX sections of the board policy series 3000, saying the changes ‘‘lower the threshold’’ for harassment and risk unintended consequences for students and staff. ‘‘I motion that we table series 3,000, specifically 3.115a,’’ Holly said, urging time to ‘‘unpack’’ new language and secure additional legal expert input.
Superintendent Ben Kirby described the changes as updates intended to align district policy with recently issued federal guidance and noted the district’s legal advisers and policy vendors had recommended revisions. He warned that ‘‘anytime a district has an obligation … and we act with deliberate indifference that does create liability for the school district,’’ and said failing to adopt guidance could expose the district to federal complaints or funding risk.
Board members who opposed tabling cited the district’s legal reviews and warned of potential liability from delaying adoption. One board member said policy providers that support the update ‘‘back their policies’’ and that delaying could reduce legal protections for the district and employees.
The motion to table was seconded and carried on a roll‑call vote; the chair announced the tabling will remove the Title IX items from the consent package and those policies will be reconsidered at a future meeting.
Why it matters: The proposed changes add protected categories and adjust investigative procedures; supporters said the updates clarify obligations and speed investigations, while opponents — including members of the public during the comment period — argued they expand definitions in ways that could affect privacy, sports participation and discipline.
