The Shelton Planning & Zoning Commission voted unanimously to rescind a previously granted approval for an accessory dwelling unit (ADU) at 395 Shelton Avenue after staff discovered inconsistent ownership documentation.
Chair Virginia Harger said staff notified the commission that the person who appeared at the Aug. 14 hearing had signed ownership affidavits as an individual, but assessor records and the deed indicate the parcel is owned by an LLC. Staff told the commission it received an LLC agent authorization on Aug. 22 that could correct the record.
Commissioner Cristiano moved to rescind the approval without prejudice, meaning the owner or authorized agent may submit a corrected application; the motion was seconded and passed by roll call 6–0. The chair said the action reflects a procedural requirement — the commission must have proper authorization from the record owner or the owner's designated agent before finalizing an approval.
No waiver of application fees was adopted at the meeting; the commission noted fees had not yet been paid and that any decision about waiving fees could be revisited should a corrected application be filed.
