Benton County’s Ditch Authority accepted and validated a petition to abandon County Ditch 4 (CD 4) and set a public hearing for April 15 at 9 a.m. Staff reported the current petition includes signatures representing 446.33 of the 693.81 benefited acres (about 64%), and explained earlier petition attempts were invalidated for reasons including outstanding assessments and incomplete property-owner signatures until owners paid assessments and resubmitted.
Staff (Christine and Michelle) described the validation process, noting they reviewed acreage and ownership records including spouses and trustees. The Authority then set the public hearing and directed staff to send notice to all benefited landowners and publish the required notice in the official newspaper as required by statute and the ditch procedures.
Members agreed on the hearing date and a 9 a.m. start time; the Authority’s public hearing will determine whether abandonment is appropriate under state ditch law and local rules, with formal notice to affected landowners to follow.
