The Nevada Department of Education on Aug. 13 reviewed proposed updates to NAC 388.435, which addresses eligibility for gifted-and‑talented programs. Lara O'Mara, an education programs professional in the Office of Comprehensive Student Services, told the workshop that the current rule's requirement for individually administered assessments creates undue hardship and can limit districts’ ability to screen broadly.
The department's four proposed changes are: remove the requirement for individually administered cognitive and achievement assessments (allowing group administration), change the required time for differentiated instruction from 150 minutes per week to 600 minutes per month for scheduling flexibility, add the use of a state‑approved rubric to determine eligibility, and update language to eliminate redundancies. Staff said the full proposed language is posted online and that no public comment was offered at the workshop for this item.
NDE said it does not anticipate impacts to small businesses and invited further written comments through the posted materials.
