Following three executive sessions, the Higley Unified School District governing board returned to open session and approved a proposed settlement in case CV 2025-013547, authorizing the district’s attorney to finalize the agreement.
Later in the meeting the board considered authorization for potential legal action regarding the EVIT satellite intergovernmental agreement (IGA) and related funding statutes. President Wade moved that the board authorize Osborne Maladon to initiate legal action on behalf of the district if needed; the motion passed with a recorded 4-1 outcome. During the vote one board member said she could not support litigation while the district was preparing to ask taxpayers for an override, citing cost and diversion of resources.
The board then voted to retain Osborne Maladon, P.A., as special counsel for the EVIT IGA matter. The minutes record both authorizations along with the settlement vote; board members said the actions were intended to protect district interests while preserving oversight of cost and strategy.
District staff provided no estimate of litigation costs during the meeting; the board instructed legal counsel to proceed only as needed and to keep the board informed of next steps.
