Staff told the authority they received the petition on Sept. 2, 2025, and that the affected parcel IDs did appear in the redetermined list of benefited owners. Citing Minnesota Statute 103E.0.805 and advice from the drainage attorney, staff recommended setting a public hearing and notifying all benefited landowners by mail; the authority instructed staff to send the notices, assess the mailing cost to Ditch 12, and post the official notice on the Benton County Drainage Authority website.
On the separate buffer-strip matter, Drain Inspector Adam reported he had contacted the landowner and received a verbal agreement that the landowner would accept responsibility for any damage caused by the tree. Adam said he had mailed a written agreement and was awaiting signatures. A commissioner moved to approve the arrangement on the condition both owners sign the agreement; the motion passed.
Next steps: staff will mail hearing notices to benefited landowners and publish the hearing notice online; staff will follow up with the landowner on the buffer-strip agreement and seek signatures from both owners before finalizing the agreement.
