The Cotati Planning Commission on Aug. 18 voted to approve an official zoning‑code interpretation that will allow certain repair and minor material‑change projects on multifamily and commercial properties to proceed with a building permit rather than a full design‑review hearing.
Staff explained that the zoning code’s design‑review requirement can require applicants to pay substantial fees and wait months even for repairs that must meet already‑adopted objective design standards. Examples staff cited include replacement siding (e.g., horizontal lap to board‑and‑batten), water‑efficient landscape retrofits required by state law, and safety work on balconies and decks following recent changes to inspection requirements.
Under the interpretation approved by the commission, projects that are primarily repairs or limited material changes and that comply with the city’s objective design standards and the Water Efficient Landscape Ordinance can be approved through the building‑permit process. The planning director will make determinations about whether a proposed change is a limited repair or a scope that still requires design review; staff will draft ordinance language to codify the interpretation.
Commissioners asked whether the change would reduce fee revenue for the planning department and staff acknowledged some reduction in design‑review fees but said building‑permit fees and inspections will still apply. Commissioners also clarified that paint color changes would not trigger design review and asked staff to limit the exemption to multifamily and commercial properties; single‑family homes already obtain building permits directly under existing practice.
The commission’s motion to adopt the interpretation passed by roll call and staff said it will return with draft ordinance language to formalize the change.
