The issue arose after county staff and a project representative told the commission the developer had not provided the letter of credit by the November 1 deadline. The project representative said the county had sent multiple reminders "2 to 3 months in advance," and staff said building permits would not be issued until the letter of credit was in place or the work verified.
Commissioners debated an initial motion to not issue permits or schedule plats while staff reviewed the developer's submittal. That first motion was seconded but failed on a recorded vote; one commissioner stated, "I voted no." After further clarification about how staff would review an engineer's estimate and confirm the contract language (including a 50% contingency fund), the commission made a clarified motion to withhold scheduling plats and not accept new plat items for the developer's agenda until staff had the required letter of credit and the chairman could sign documents. That clarified motion passed.
County staff said they would evaluate the engineer's estimate of remaining work and ensure the letter-of-credit amount and agreement language reflect the scope, including contingency provisions.
The commission's action does not cancel previously issued permits but places a hold on future agenda scheduling and permit issuance tied to the developer until the specified financial assurances are submitted and reviewed. The matter will return to the board once staff confirms compliance and the chairman signs the paperwork.
