Council approves Stardale subdivision private-street request, sets maintenance and inspection conditions

The Star City Council on Aug. 19 approved a request to recognize a street in the Stardale subdivision as a private road rather than accept it as a public street. Antonio Cunti (engineer/representative) and property owner Francisco Lopez told the council the road was built to ACHD standards but that ACHD did not witness inspections on-site during construction and therefore cannot accept it as a public street without re-inspection.
Antonio said geotechnical testing and compaction reports exist and that the project team will provide certified test reports and engineer certification demonstrating compliance with required standards. Staff (Ryan) said the city will require stamped testing reports, conduct its own measurements and verify compliance before signing the final plat. Applicant and owner representatives said maintenance will be the responsibility of the HOA under CC&Rs; staff will place maintenance agreements and inspection requirements on the final plat as conditions.
Council discussed risks of later HOA dissolution and requirements that HOA maintenance obligations be preserved; staff offered language that would make maintenance obligations difficult to disband without council approval. Councilmember Nielsen moved to approve the private-street application with staff adding required conditions of approval (including maintenance agreements); the motion passed by roll-call vote (ayes from Hershey, Wheelock, Solomonson, Nielsen).
Staff noted owners may still be required to supply periodic inspections or reserve studies (the packet references a three-year visual inspection obligation) and that ACHD would require re-construction to public standards only if final acceptance procedures by ACHD are later required but cannot be completed without on-site witnessing of the required testing reports.
The council's approval allows the final plat process to continue subject to the listed conditions and to submittal of certified compaction and testing reports for staff review and acceptance.
