The Rush County Board of Commissioners agreed to revise language in Section 7.11 (0.4) of the county zoning ordinance following a referral from the Area Plan Commission. Speaker 4 told commissioners the Area Plan Commission held a public hearing on Feb. 5 and unanimously recommended adding wording to clarify that applicants retain the right to seek relief through the board of zoning appeals or the courts rather than being granted a special exception automatically.
"Sometimes there are very peculiar things that come up that aren't explained in the ordinance," Speaker 4 said, explaining the amendment is intended to provide an applicant an opportunity to pursue judicial or appellate review rather than creating automatic approval.
Commissioners discussed the proposed change briefly, then moved and seconded to rework the ordinance language; the motion carried by voice vote. Meeting remarks stressed the revision is intended to clarify process and does not itself grant special exceptions.
The board directed staff to prepare updated ordinance language for formal adoption procedures.
