Scurry County court simplifies developer road-repair agreement, debates bonds and enforcement

County commissioners discussed and moved to approve revisions to the county’s Road Use/Repair Agreement (RUA) that would simplify legal language and reassign day-to-day repair responsibility to county crews, who would then seek reimbursement from developers.

A precinct speaker and other commissioners said the version under review had become “convoluted” with attorney-drafted language that did not reflect field realities. They described instances where outside contractors performed unsatisfactory repairs, roads were left rough after developer work, and safety incidents occurred (vehicles overturned; trucks slid off bridge railings). Commissioners argued the county can perform repairs more effectively and for less cost and should retain the principal role in remedial work during development.

Members debated whether to require cash bonds or other security from developers and whether bonds provide sufficient enforcement. Commissioners also discussed adding clear contact and notification language to ensure county staff receive pre-construction videos and documentation and can respond at project start rather than after problems develop. One speaker suggested adding commissioner contact names for each precinct to the agreement to ensure on-the-ground communication.

The court agreed to adopt the proposed changes subject to review and approval by the county attorney (Mike) and to place the item on the next agenda if additional revisions are needed.
