The developer asked to replace an $886,703.02 performance bond with a $44,346.07 cash deposit for off-site Paul Street repairs. County engineering advised against partial release of large financial guarantees because such bonds ensure completion of both on-site and off-site infrastructure and because reducing the bond can reduce the county’s leverage to finish work if a developer fails to complete commitments. The engineering office recommended the county keep the full guarantee in place.
Developers and their counsel explained weather delays and contractor availability after the flood, and said roughly 90% of the subdivision work has been completed; they offered additional safeguards, including $63,000 in retained contractor funds and readiness to provide an additional cashier’s check. Commissioners discussed precedent and a middle-ground approach to protect county interests while allowing phase-two construction to begin.
After extended debate, the court adopted a conditional motion to release the original performance bond contingent upon acceptance of a new financial guarantee comprising the developer’s cash deposit plus an additional cashier’s check to increase coverage (totaling an additional deposit of $88,006.92 as negotiated on the floor). The motion passed with a 2–1 vote (Precincts 2 and 4 in favor; Precinct 3 opposed). Commissioners emphasized the release was conditional on the treasurer’s office accepting the new deposit and on revised documentation tying the new guarantee to the right-of-way permit.
Implementation and next steps
County staff instructed the treasurer to accept the new cashier’s check and said the release of the prior performance bond would follow only after proper receipt and accounting; the court’s order required the developer to file the supplemental financial guarantee and associated paperwork before the prior bond would be released.
