A Hood County resident raised pointed questions about the county's oversight of the YMCA lease during public comment at the March 25 commissioners court, and county officials and counsel described the history of oversight meetings, construction provisions in the original contract and prior court action.
Tina Brown asked whether the oversight committee that the court created met as required, whether YMCA representatives were consulted and why the contract had to be updated. "I'm wondering about the oversight committee that was formed. How many times did y'all meet and did you speak with anybody with the Y?" Brown asked.
Commissioner Samuelson and county staff said the oversight committee met several times in 2023 with YMCA representatives to address maintenance and construction-related items flagged by county staff and that, once those issues were resolved, the committee did not continue regular quarterly meetings. Staff noted some items (for example, insurance documentation and named insured status) remained outstanding and were the subject of continued communication.
County attorney (identified in the transcript as Miss Mills) told the court that the county had exercised its contractual right to terminate the agreement previously and that the court had voted 5-0 on that action. "We've exercised our right to terminate… I think that was a 5 0 vote," she said, describing termination as a viable legal action and noting the court is now working to negotiate a revised term.
Officials said some language in the original contract addressed construction obligations and that the presence of construction terms in the lease had led to public questions about whether the bond referenced at the time of passage had been intended to pay for a YMCA facility. County staff encouraged interested residents to review video of a prior special-called meeting where the timeline was explained.
The court later convened into executive session on a real estate matter and on a security audit; upon returning the judge reported no action was taken and that negotiations would continue.
No final decision on the YMCA lease was reached at the March 25 meeting; commissioners and staff indicated they would continue discussions and brought the county attorney's prior termination action and the committee's work to the public record.
