Councilman McGeoger and others noted legal limits. The City Attorney advised that the city can track contractor issues and bring evidence to the council, but formal disqualification (a finding of non-responsibility) must follow the public-procurement procedures in the Public Contract Code.
Council considered two motions: an amended motion from Council Member Fink to add direction for staff to track bidders, and a motion to accept staff’s procurement recommendation. The motion to accept the staff recommendation passed with a 4-1 tally; Council Member Fink cast the lone dissent. The council also directed staff to develop a non‑disqualification tracking mechanism so problem bidders can be documented for future council consideration.
