Board hears report on state law changes to independent study; staff outlines implementation and local data

Peter Lambert and other staff presented proposed revisions to board policy 6.158 to align with recent state changes to independent study law. Lambert summarized the state changes and the policy update.

"In June 2023, senate bill 114 made significant changes to education code 46393, which provides independent study in the event of public health emergencies, natural disasters, and other safety hazards," Lambert said, explaining the changes give more flexibility for students and staff.

Staff highlighted two takeaways: short‑term independent study now extends up to 15 days (previously up to 14), and the prior 3‑day minimum has been removed so independent study can be as short as one day, enabling potential ADA recovery for brief absences.

David Voyevich (principal at Independence/Valley Robotics Academy) and teacher Brad Braden described local practice. Braden said he has worked in independent study for decades and that, "So far this year, I've served 268 students through short term independent study ... That equals 2,912 days of attendance (through the third quarter)." He said the expanded flexibility helps families manage short‑term needs like travel, cultural observances and emergencies without educational loss.

Staff said next steps include training for staff, family communications, guidance updates for sites and ongoing review of how the updated policy is working. The presentation noted staff will engage site administrators and teachers to update local guidance for independent study.

Board members had few questions during the report; staff emphasized coordination with site administrators for rollout and monitoring.
