Planning commissions approve conditional use permit for oversized pool house in Almond Acres Subdivision

Lincoln County and the City of Sioux Falls planning commissions voted to approve a conditional use permit that will allow a homeowner in Almond Acres Subdivision to exceed the 1,200-square-foot accessory building threshold.
The application, presented by planning staff, covers a 1.3-acre property adjacent to Highway 11 south of Sioux Falls. Staff reported the lot already contains a 1,008-square-foot accessory building and that the proposed pool house with overhang would bring the accessory total to about 1,204 square feet. "Staff does recommend approval of this application because it does meet the standards of the ordinance," planning staff said during the meeting.
The applicant, Adam Sunderman, identified himself for the record and described the plan as a family pool house to be sited at the back of the new pool. "Our family's requesting permission to exceed the accessory building square footage on our property," Sunderman said, adding the project will meet setback requirements and that the family will provide an elevation certificate upon completion.
County staff noted that accessory structures exceeding 1,200 square feet in subdivisions of more than four lots require a conditional use permit under the joint zoning ordinance; staff also said the proposed accessory area would remain less than the dwelling's finished habitable space. Staff reported posting the property and said no public comments were received before or during the hearing.
A county commissioner moved to approve the permit with the six standard conditions recommended in the staff analysis; a county roll call recorded affirmative votes by Commissioners Breutz, Sweeter, Green and Jones. The City of Sioux Falls planning commission likewise moved, seconded and carried the item on its side. The county staff indicated the typical six conditions will apply; those conditions were identified in the staff analysis but not read verbatim into the record.
Appeal rights were noted at the meeting: decisions on conditional use permits may be appealed to the Lincoln County Board of Commissioners and the Sioux Falls City Council by submitting a letter to the County Planning and Zoning office within five days.
The permit was approved by both commissions; staff will implement the conditions and the applicant indicated he will proceed with the elevation work and follow the conditions.
