Dr. Sylvia Kaufman introduced the recommended MOU, saying the agreement is needed "when a school district is unable to provide an appropriate educational program for students with special needs" and that an outside public educational agency or certified nonpublic school can be engaged to meet the student’s IEP requirements.
Board leadership noted a potential appearance‑of‑impropriety and Trustee Klotzker asked to abstain from the vote because she is employed within Anaheim Union High School District’s special‑education department. "Trustee Klotzker has asked to abstain from voting on the MOU because she is employed by the Anaheim Union High School District within their special ed department," the board stated on the record.
The board moved and seconded the item and recorded 3 ayes and 1 abstention. No legal conflict of interest was asserted; the abstention was taken "in order to avoid any appearance of impropriety," the board said.
No further amendments or conditions to the MOU were recorded in the meeting minutes; staff were authorized to finalize and execute necessary paperwork on the district’s behalf.
