At an administrative hearing Aug. 21, Hearing Officer Kellen Spielman granted preliminary approval for SD 02225, the East Edition Beaver Subdivision, a request to split a roughly 3.21‑acre parent parcel into three lots ranging from 0.97 to 1.25 acres near Mission Road and Old Mission Road.
Planning staff summarized the file and recommended approval. Staff member Mr. Stefan told the hearing that the proposal qualifies as a quick plat because it creates four or fewer lots and meets access standards, and he outlined the parcel’s title history, past waiver subdivision and a Department of Transportation take that reconfigured Mission Road. Mr. Stefan said the preliminary plat includes a note prohibiting direct lot access to Mission Road to comply with Title 17 and that DOT and the borough engineer waived corner‑rounding dedication.
Applicant representatives acknowledged the title history issues were resolved. Owner Jesse Bauer asked the hearing officer to lift plat note No. 8, which restricts access to Mission Road; Hearing Officer Spielman said that lifting such a restriction would require a variance before the planning board and could delay approval by months. Instead, he approved the quick‑plat request subject to four conditions, adopting the staff report and findings of fact A–D, and said a final plat prepared by a registered land surveyor must be submitted to the community planning department within 24 months or the preliminary approval will lapse.
The hearing officer also noted appeal procedures: any appeal of the administrative decision must be filed in writing with the borough clerk’s office within 10 calendar days. The decision takes effect as issued; any request for a variance on access to Mission Road would follow the planning‑board process and separate public notice requirements.
The approval records the staff conditions, including standard utility responses and a surveyor’s certification on the final plat; no members of the public testified on this item.
