Councilor Scarpelli read an emailed legal memorandum from KP Law that cautioned the council about potential conflicts with Massachusetts statutes governing municipal trust investments and fiduciary responsibilities, and recommended consultation with the treasury/finance director, bond counsel and other financial stakeholders before adoption. The memorandum also said parts of the draft ordinance used vague terms such as “financial instruments” that should be clarified.
Supporters argued the ordinance would prompt more careful investment oversight and provide a tool to align municipal assets with community values. Councilor Callahan said legal obstacles do not preclude the council from pursuing policies the community demands: "It is not our job as an elected body to uphold legal opinions that go against the values of our residents," she said, and added that concerns about profit as the only permissible objective of municipal investments should not automatically block value‑based policies.
The Board of Commissioners of the Trust Funds submitted a written statement (read at the meeting) urging caution and reiterating statutory obligations for trust funds to prioritize preservation and reasonable returns and noting potential incompatibility with donor‑restricted trust terms.
After public comments and further council debate about process and timing, the council voted on a motion to take the ordinance from the table and approve it for third reading.
