City planning staff presented the annual development agreement compliance report for Merlone‑Geyer, which covers milestones and monetary obligations through the compliance period ending 04/21/2025. Staff told the council the developer is in compliance with the terms and conditions in the agreement and that the developer’s recent request for a major modification is a separate process that has not been approved.
Councilmember Hazel and others relayed constituent reports that the site had not been maintained to the community’s expectation and raised concerns about security near retail areas. Sheriff Captain Burke said there was an uptick in organized retail theft last year affecting nearby retail outlets (Nordstrom Rack, REI, Trader Joe’s) and that frequent patrols and a decoy vehicle were among measures used to deter theft; he said there were no specific crime spikes tied to the open area in question. Staff said they would follow up with the developer regarding site maintenance and, where appropriate, remind them of obligations in the development agreement.
After discussion, the council received the report as required by municipal code and adopted staff’s recommendation that the developer was in compliance for the reporting period; the major modification request is separately processed and does not affect the annual compliance finding.
