Council approves amendment requiring proof of county health permit for sidewalk vendors

The council opened a public hearing on amendments to Fountain Valley Municipal Code Chapter 4.9 governing sidewalk vendors. Principal Planner Stephen Ayers said the code (ordinance adopted June 25, 2019, ordinance 1547, in accordance with Senate Bill 946) currently does not require applicants to provide proof of Orange County Health Department approval. Ayers told the council the proposed amendment would require proof of the county health permit as part of the sidewalk-vendor application to ensure food vendors meet county health standards and to help protect public health.
Councilmember Constantine asked whether permits must be displayed; staff confirmed display requirements exist in the municipal code and that the county also has posting requirements. Councilmember Harper moved to approve the ordinance and amend it to require display of the city permit and, where feasible and non-conflicting, the county permit; the council directed staff to reconcile display wording with county rules to avoid conflicting posting requirements.
City staff confirmed the sidewalk-vending permit posting requirement appears in section 4.9005(b) and said they would return with any substantive amendments for second reading to ensure consistency with county health posting rules. The council approved the ordinance amendment on first reading; the meeting record shows Item 5 passed 5-0.
