Buena Park adopts subcontractor disclosure ordinance requiring contractor disclosure on large projects

Buena Park’s City Council unanimously adopted an ordinance adding Chapter 5.62 to the municipal code on May 20, establishing licensing and disclosure requirements for contractors and subcontractors on larger private construction projects.
City Attorney and Public Works Director Mina McHale presented the ordinance, which requires contractors on covered projects to submit a list of subcontractors, verification of workers’ compensation insurance, state contractor license and license category, city business license and federal tax ID, and disclosure of any pending or final state or federal labor code determinations in the past five years. Covered projects include residential developments with 20 or more units, commercial or industrial projects of 20,000 square feet or more, or any project valued at $5,000,000 or higher.
Jimmy Elrod of the Western States Regional Council of Carpenters urged council support, framing the ordinance as a transparency measure that protects workers and helps the city avoid hiring contractors who have a record of labor violations.
The ordinance will be enforced through administrative citations implemented by building and code enforcement and will not apply to smaller projects that fall below the thresholds set out in the code.
What happens next: the ordinance becomes effective within 30 days; staff will implement the administrative enforcement approach and integrate the disclosure requirements into permit review for covered projects.
